In the realm of BYLT Living, our commitment to quality is unwavering. It’s essential to clarify upfront that no one in the BYLT Living network – be it distributors, retailers, dealers, resellers, agents, or team members – has the authority to tweak, extend, or append anything to this warranty. It’s a steadfast agreement, and we’re sticking to the script.
Comprehensive Warranty
At the heart of BYLT Living Inc. (“BYLT Living”) are products (“Products”) designed with meticulous care. We stand by the promise that these Products are free from defects in materials and craftsmanship under normal usage for which they were intended (“Defect”). This warranty spans one (1) year from the initial retail purchase date, aptly termed the “Warranty Period.”
Initiating a Warranty Claim
Should you detect what appears to be a Defect in the Product, swift action is key. Reach out to the dealer from whom you made the purchase. Share tangible proof of the original retail purchase date, such as a receipt or credit card statement. If the dealer proves elusive, a direct line to BYLT Living at BYLTLiving@gmail.com is at your disposal.
BYLT Living’s Response to Warranty Claims
Upon receipt of a notice regarding a potential Defect within the Warranty Period, BYLT Living will execute the following steps. Post-notification, BYLT Living may request visual evidence, such as videos or images, showcasing the purported Defect. It’s imperative to note that BYLT Living carries no obligations under this warranty if: 1) visual documentation is prohibited; or 2) post-inspection, BYLT Living determines that the Product fails to meet the specified warranty requirements.
In the event of a confirmed Defect, BYLT Living will facilitate the replacement of the Product. Expect a BYLT Living Product identical in color, design, style, and quality to land on your doorstep at no cost. If identical materials prove elusive during the replacement process, BYLT Living reserves the right to substitute with materials of equal quality or issue a refund. In the rare case that BYLT Living lacks the required material but you or the dealer possess it, a shipping label will be generously provided by BYLT Living for the material’s procurement. BYLT Living also retains the right to request the return of the product in question at its expense.
It’s crucial to understand that the replacement of a BYLT Living Product with this warranty does not extend the duration of the Warranty Period or usher in a new Warranty Period.
Limitations of the Warranty
Certain conditions may diminish or exclude BYLT Living’s responsibilities and liabilities under this warranty:
Original Purchaser
This warranty extends exclusively to the Original Purchaser of a BYLT Living Product. The term “Original Purchaser” refers to the first individual who foots the bill for the Product – commonly recognized as the “end consumer.”
Proper Installation, Maintenance, and Use
BYLT Living Products demand a precise entry, adhering to the BYLT Living Template, meticulous maintenance, and designated use. This warranty does not cover Products that have been:
a) installed in a manner contrary to the Product installation guide;
b) installed without the use of a coordinating BYLT Living Template;
c) improperly stored, maintained, or repaired;
d) modified, tampered with, or intentionally damaged;
e) amalgamated or used with third-party components;
f) subjected to accidental damage – including burns, cuts, cracks, tears, scratches, scuffs, stains, dropping, and indentations; or
g) adversely affected by natural disasters beyond human control – such as lightning, flooding, weather extremes, earthquakes, or other natural phenomena.
HVAC System Exemption
The onus falls on the purchaser and end user to ensure the compatibility of BYLT Living Products with their HVAC system. This warranty excludes any repair or replacement of an HVAC system, furnace, electrical system or components, or any other mechanical damage or labor costs stemming directly or indirectly from the installation and use of the Product.
Disclaimer Insights
This warranty and the solutions presented herein stand as exclusive, taking precedence over any other oral or written warranties and remedies. BYLT Living explicitly disclaims any and all representations and warranties not explicitly stated in this warranty. All implied warranties, including those of merchantability and fitness for a particular purpose, are disclaimed by BYLT Living. In the event that legal constraints prohibit BYLT Living from disclaiming or excluding implied warranties under applicable law, any claims under such implied warranties shall expire upon the termination of the Warranty Period.
Limitation of Liability Framework
To the maximum extent permissible under applicable law, BYLT LIVING’S maximum aggregate liability under, arising out of, or relating to, the Product shall not surpass the total amount paid for the Product by the Original Purchaser.
Further, BYLT Living holds no liability for loss of profits, revenues, or income, loss of use, cost of procurement of substitute goods or services, or for indirect, special, economic, punitive, incidental, indirect, or consequential damages – irrespective of cause and under any theory of liability. This includes breaches of contract, tort (including negligence and strict liability), or any other grounds, whether BYLT Living had prior notice of the possibility of such damages.
Weight Considerations
BYLT Living Products are susceptible to damage if improperly installed or subjected to excess weight.
Always check with the manufacturer of the flooring to determine maximum weight allowance on your floor material. While we maintain that regular use should not damage the floor, we do not recommend applying direct wight to the floor vent for an extended period.
Cautionary note: Sliding furniture across a BYLT Living Product could result in damage not covered under the warranty.
Practical advice includes avoiding heavy furniture legs, chair legs, bed frames, or any objects exerting excessive weight in a confined surface area. Let’s prioritize maintaining the integrity of the Product over unnecessary wear and tear.
